These terms are the agreement between you and SayEstimate. By creating an account or using the app, you agree to them. We've written them to be clear, not to trap you.
SayEstimate is operated by A&A Investments LLC ("SayEstimate," "we," "us"), Lawrenceburg, Tennessee, United States. You can reach us at support@sayestimate.com.
SayEstimate is software that helps contractors create estimates and invoices, track expenses and schedules, and accept payments. It is a tool you use to run your business, it is not a party to any agreement between you and your customers, and it does not perform any contracting work.
You must be at least 18 and able to form a binding contract. You're responsible for keeping your login secure and for everything that happens under your account. Tell us promptly at support@sayestimate.com if you suspect unauthorized use. The information you provide must be accurate and kept up to date.
You agree not to misuse the service. In particular, you won't: break the law or infringe others' rights; send spam or unlawful, deceptive, or harassing content; upload malware; attempt to breach, probe, or disrupt the service or its security; scrape or overload it; or use it to store or process information you don't have the right to. You are responsible for the content you enter and for having permission to use your customers' information.
You own the content you put into SayEstimate, your business information, your customers' details, your estimates, invoices, and files. You grant us a limited license to host, process, and transmit that content solely to provide and improve the service for you (for example, to email an estimate to your customer or generate an AI draft you requested). We don't claim ownership of your content, and we don't sell it.
Some features use artificial intelligence to draft estimates, read receipts, or suggest prices. AI output can be wrong or incomplete. Always review AI-generated numbers, line items, and totals before you send them or rely on them. You are responsible for what you send to your customers.
SayEstimate provides software, not legal, tax, financial, or accounting advice. Pricing suggestions, tax calculations, and financing options shown in the app are informational and are your responsibility to verify. For advice specific to your situation, consult a qualified professional.
The app relies on and integrates with third parties such as Stripe, Supabase, Netlify, Resend, Anthropic, Google, and (if you connect it) QuickBooks. Your use of those integrations may also be subject to their terms. We are not responsible for third-party services we don't control.
We work to keep SayEstimate reliable, but we don't guarantee it will always be available, uninterrupted, or error-free. We may modify, suspend, or discontinue features, with reasonable notice where practical.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, SAYESTIMATE AND A&A INVESTMENTS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless SayEstimate and A&A Investments LLC from claims, damages, and expenses arising out of your content, your use of the service, your dealings with your customers, or your violation of these terms or the law.
You can stop using SayEstimate and close your account at any time. We may suspend or terminate your access if you violate these terms or use the service in a way that risks harm to others or to the service. On termination, your right to use the service ends; sections that by their nature should survive (such as payment obligations, disclaimers, and limitations of liability) will survive.
These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Tennessee, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.
We may update these terms from time to time. When we make material changes, we'll update the effective date and, where appropriate, notify you in the app. Continuing to use SayEstimate after changes take effect means you accept the updated terms.
